Bandwidth Innovation Studio Supplemental Terms

PLEASE READ THESE BANDWIDTH INNOVATION STUDIO SUPPLEMENTAL TERMS (“TERMS”) CAREFULLY. ONCE ACCEPTED, THESE TERMS BECOME A BINDING AND ENFORCEABLE LEGAL COMMITMENT BETWEEN YOU AND BANDWIDTH.
You accept and agree to be bound by these Terms on behalf of your organization by (a) signing up for access to any Bandwidth Innovation Studio Services, (b) accessing or using of any of the Bandwidth Innovation Studio Services, or (c) checking the “Agree and Continue” box or otherwise agreeing to be bound by these Terms.  You represent and warrant that you have the legal authority to bind your organization to these Terms.  IF YOU DO NOT UNCONDITIONALLY AGREE TO ALL OF THESE TERMS, USE OF ANY BANDWIDTH INNOVATION STUDIO SERVICES IS STRICTLY PROHIBITED AND YOU MUST NOT ENABLE OR USE ANY INNOVATION STUDIO SERVICES. 

1. Services Overview and Terms
   1. Overview.  “Innovation Studio” refers to Bandwidth’s platform (currently located at https://www.bandwidth.com/innovation-studio/) through which Bandwidth may provide access to one or more experimental releases of its proprietary, cloud-based tools or platforms (each, an “Innovation Studio Service”) solely on a “beta” basis. Access to Innovation Studio Services is entirely optional and Customer must actively choose to enable Innovation Studio Services.  Customer is not required to use any Innovation Studio Services as a condition to accessing Bandwidth’s other products or services.
   2. Applicable Terms; Updates.  Except as otherwise set forth herein, Customer’s access to, and use of, any Innovation Studio Services is subject to Customer’s compliance with these Terms, which are fully incorporated into the Bandwidth Communications Services Agreement or any other separate written agreement entered into between the Parties in which Customer is expressly authorized to use the Services solely for its own internal business purposes, as applicable (the “Services Agreement”) and the Bandwidth Acceptable Use Policy. Capitalized terms not defined herein have the same meaning as set forth in the Services Agreement. To the extent there is a conflict between these Terms and the Services Agreement, these Terms shall apply, but only with respect to Innovation Studio Services. For clarity, all Innovation Studio Services are made available to Customer as “beta offerings” and “Electronic Tools” as such terms are used in the Services Agreement. We may update these Terms from time to time, provided that we provide prior written notice of material updates in accordance with the Services Agreement. Continued use of any Innovation Studio Services on or after the date of the updated version of these Terms constitutes Customer’s acceptance of the updated version, which supersedes all prior versions of these Terms.
2. Use of the Innovation Studio Services; Restrictions
   1. Limited Use.  Customer agrees it will only access and use the Innovation Studio Services for:  (i) its internal, limited use in the United States in connection with Customer’s testing and evaluation of such Innovation Studio Services, and (ii) in accordance with any other limits set forth in Exhibit A attached hereto (the “Limited Use”). Without limiting the foregoing, other than Customer’s employees, consultants, contractors, and agents who are expressly authorized by Customer to use Innovation Studio Services for the Limited Purpose, Customer shall not allow any third party to access or use the Innovation Studio Services.
   2. Compliance with Laws.  Customer is solely responsible and liable for the deployment of the Innovation Studio Services for Customer’s use case and acknowledges that Bandwidth does not control how Customer uses or deploys the Innovation Studio Services. Customer is responsible for using the Innovation Studio Services in a manner that complies with all applicable laws and regulations.
   3. Restrictions.  Customer shall not, and shall procure that its End Users shall not, directly or indirectly: (i) interfere with or circumvent any feature of the Innovation Studio Services, including without limitation any security or access control mechanism or other mechanism designed to obtain or provide consents or notices to End Users or call participants; (ii) access or use the Innovation Studio Services to build or train a similar or competitive product or service or develop any artificial intelligence or other machine learning model or technology; (iii) use the Innovation Studio Services in connection with any services or communication system in which the failure of the Innovation Studio Services could lead directly to death, personal injury, or physical or environment damage; (iv) use the Innovation Studio Services for any activity that is subject to government regulation or requires clearance or approval from a regulatory authority; (v) use the Innovation Studio Services outside of the United States or with users originating outside of the United States; (vi) remove, alter, or obscure any notices of Bandwidth or its licensors on, or that are provided through, the Innovation Studio Services; (vii) otherwise use the Innovation Studio Services in any manner that exceeds the scope of the Limited Use or in a manner inconsistent with applicable law, any provided documentation, the Acceptable Use Policy or these Terms; or (viii) use any Output (defined below) in a manner that falsely represents or implies such Output (defined below) was not generated by AI Features (defined below). Bandwidth reserves the right to suspend and/or terminate Customer’s or any End User’s access to the Innovation Studio Services for any failure, or suspected failure, to comply with the foregoing conditions.
3. AI Features
   1. Overview. The Innovation Studio Services may include or leverage artificial intelligence, machine learning and deep learning platforms, algorithms, tools and models (collectively, “AI Features”) that are capable of generating output, responses, data, or other information (collectively, “Output”) in response to voice prompts, information, queries or other materials provided or submitted by or on behalf of Customer or its End Users for use in connection with the Innovation Studio Services (collectively, “Inputs”).
   2. Consents.  Some Innovation Studio Services may use speech recognition technology or natural language understanding and involve the recording, monitoring or capture of real-time communications that requires the informed consent from participants in such communications in accordance with applicable law or regulation.  While Bandwidth may make available certain mechanisms as part of the Innovation Studio Services for the purpose of obtaining consent from participants, the Innovation Studio Services are not designed to provide legal advice to Customer, and Customer is solely responsible for determining if any additional notices or consents need to be provided or obtained, and for ensuring that Customer has provided any required notices or consents.
   3. Customer’s Responsibility for AI Inputs and Outputs; Disclaimers.  Customer acknowledges that Outputs are based on Inputs, and that Bandwidth has no control over any such Inputs. Additionally, Customer acknowledges that the Innovation Studio Services are in “beta” mode and may provide Outputs that are inaccurate, offensive, or not designed or intended to meet Customer’s needs, expectations, or legal, regulatory, or compliance obligations. Customer is solely responsible for its Inputs and its use of the Outputs, including for determining whether the Output is appropriate for its intended use and for its End Users’ use thereof. BANDWIDTH DOES NOT MAKE, AND HEREBY EXPRESSLY DISCLAIMS, ANY REPRESENTATIONS AND WARRANTIES WITH RESPECT TO ANY OUTPUT PROVIDED IN CONNECTION WITH THE INNOVATION STUDIO SERVICES.  ALL OUTPUTS ARE PROVIDED “AS IS” AND “WITH ALL FAULTS,” AND BANDWIDTH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND OR NATURE WITH RESPECT TO ANY INPUTS OR OUTPUTS.  Due to the nature of artificial intelligence or machine learning technology, Output may not be unique, and Customer acknowledges that Bandwidth may generate the same or similar Output for other customers.
   4. Third Party Services. The Innovation Studio Services may rely on artificial intelligence or machine learning technology or services not provided by Bandwidth (“Third Party Services”).  By using the Innovation Studio Services, Customer authorizes Bandwidth to disclose any Customer Data, including Inputs, that Customer makes available to the Innovation Studio Services to the providers of such Third Party Services.
4. Ownership; Licenses
   1. Ownership. The Innovation Studio Services are proprietary to Bandwidth, and Bandwidth and its licensors retain all rights, title and interest (including all intellectual property rights) therein and to all improvements, enhancements and modifications thereto. No implied license of any kind is granted to Customer.  As between the Parties, Bandwidth will exclusively own all right, title and interest in and to Bandwidth’s artificial intelligence, machine learning and deep learning platforms, algorithms, tools and models, and any improvements, enhancements and modifications thereto, including those generated as a result of training on Customer’s Inputs, Outputs, or any other Customer Data provided by Customer to the Innovation Studio Services.
   2. Licenses from Customer.  Customer grants Bandwidth a perpetual, irrevocable, non-exclusive, worldwide, royalty-free and fully paid license to use, copy, modify, make derivative works of, process and store Input, Output and all other Customer Data provided to or generated by the Innovation Studio Services: (i) for purposes of providing the Innovation Studio Services to Customer and its End Users, and (ii) to develop, improve, test, and train Bandwidth’s products, services and artificial intelligence and machine learning technology models, as well as models provided by third party service providers. Customer represents and warrants that it has the necessary rights to grant all licenses hereunder and that it has obtained all necessary consents, permissions, approvals, and/or licenses to permit Bandwidth to use the Input and other Customer Data provided to the Innovation Studio Services for the purposes of performing its obligations and exercising its rights and licenses under these Terms.  
   3. Data Processing. To the extent that any Inputs, Outputs or other Customer Data provided to the Innovation Studio Services contain any Personal Data, Bandwidth will be an independent controller of such Personal Data and the Innovation Services Privacy Policy attached at Exhibit B will apply.  Customer acknowledges that the provisions of Section 6 (Confidentiality and Use of Personal Data) of the Services Agreement and the DPA will not apply to the extent that they would otherwise be deemed to prohibit Bandwidth from exercising its rights or performing its obligations under these Terms.
   4. Feedback. In exchange for Customer’s use of Innovation Studio Services, Customer agrees to provide  feedback or information regarding errors, problems, defects, or suggestions for changes and improvements (collectively, “Feedback”) related to the Innovation Studio Services. Customer further grants Bandwidth a worldwide, non-exclusive, irrevocable, perpetual, sublicensable, fully paid-up, royalty-free right and license to use, exploit and otherwise incorporate such Feedback into Bandwidths’ technology, products and services.
5. Disclaimers; Indemnity; Limitation of Liability
   1. No Warranties.  Customer understands and agrees that the Innovation Studio Services are provided on a “beta” basis and may contain bugs, defects, omission, errors or other problems.  Bandwidth does not guarantee the uptime, reliability, performance or availability of any Innovation Studio Services, and reserves the right to discontinue the Innovation Studio Services at any time without notice.  Bandwidth will have no obligation to indemnify Customer for any Innovation Studio Services.  To the maximum extent permitted by law, the Innovation Studio Services and all related documentation and materials are provided on an “AS IS”, AND “AS AVAILABLE” basis, with all faults. BANDWIDTH MAKES NO WARRANTIES WITH RESPECT TO THE INNOVATION STUDIO SERVICES OR THE THIRD PARTY SERVICES, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, INCLUDING WARRANTIES OF TITLE, ACCURACY, INTERFERENCE WITH CUSTOMER’S QUIET ENJOYMENT, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  THE ENTIRE RISK ARISING OUT OF THE USE OF THE INNOVATION STUDIO SERVICES AND THE THIRD PARTY SERVICES IS ASSUMED BY CUSTOMER.  BANDWIDTH MAY, UPON NOTICE TO CUSTOMER, DISCONTINUE THE INNOVATION STUDIO SERVICES.
   2. Indemnity. In addition to and without limiting Customer’s obligations under the Services Agreement, Customer shall defend the Bandwidth Indemnified Parties from and against any and all Claims made against Bandwidth by third parties as a result of Customer’s provision of any Inputs or other Customer Data to the Innovation Studio Services or for any violation by Customer of these Terms.
   3. Limitation of Liability. THE TOTAL CUMULATIVE LIABILITY OF BANDWIDTH AND ITS LICENSORS (IF ANY) ARISING OUT OF OR RELATED TO THE INNOVATION STUDIO SERVICES SHALL BE LIMITED TO ONE HUNDRED DOLLARS (U.S. $100). THIS LIMITATIONS OF LIABILITY FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES.

Exhibit A 
Innovation Studio Service-Specific Limitations
In the event of conflict between the Terms and this Exhibit A, the terms of this Exhibit A will control with respect to the subject matter contained herein.

Harmony Voice AI Receptionist

1. Service Description. Harmony Voice AI Receptionist is an interactive AI voice agent (“Agent”) within Customer’s Account which can assist in scheduling, basic receptionist tasks, and call forwarding. Customers can configure the Agent by selecting a voice profile, providing company details (e.g., description, business hours, and website), creating or uploading a custom greeting, and defining certain actions (e.g., scheduling meetings via calendar integration transferring the call to a live agent).

2. Self-Hosted Model. Harmony Voice AI Receptionist operates using Bandwidth self-hosted models. Customer Data will be processed locally and will not be shared with any third-party model provider for training or secondary purposes.

3. Use Limitations

1. Evaluation Period. Customer is entitled to use Harmony Voice AI Receptionist for up to ninety (90) days following the date Customer accepts and agrees to be bound by these Terms (“Evaluation Period”), unless otherwise extended with the prior written consent of both Parties; provided, however, if Bandwidth reasonably determines at any time during the Evaluation Period that Customer is no longer actively analyzing and/or evaluating Bandwidth’s products and/or services as contemplated by these Terms, Bandwidth may immediately terminate this the Evaluation Period by providing you with written notice.

2. Usage Limitation. During the Evaluation Period, Customer is entitled up to 1,000 minutes of usage per month.

3. Location Limitation. Harmony Voice AI Receptionist is not available to residents of or users located in the State of California.

Speech to Text API

1. Service Description. Speech to Text API enables real-time transcription based on Customer’s uploaded audio streams or live audio. The Speech to Text API converts spoken audio into machine-readable text output delivered to Customer via API.

2. Use Limitations

1. Usage Limitation

1. Customer’s use of Speech to Text API is subject to both rate limiting and usage limiting controls that Bandwidth has the right to invoke and change at its sole discretion.

2. Bandwidth reserves the right to monitor Customer's use of the Speech to Text API for excessive usage, unauthorized use, or any use that Bandwidth reasonably determines to be abusive or inconsistent with the intended purpose of the Speech to Text API (collectively, “Unauthorized Use”). Bandwidth may, in its sole discretion, suspend or terminate Customer's access to the Speech to Text API upon notice if Bandwidth determines Customer's usage constitutes Unauthorized Use or otherwise violates these Terms.

2. Redaction Limitation

1. Customer may choose to enable the redaction feature associated with the Speech to Text API (“Redaction Feature”). The Redaction Feature uses machine learning to identify and redact certain categories of sensitive data from transcribed content. However, due to the predictive nature of machine learning, the Redaction Feature may not identify and remove all instances of sensitive data in Customer’s applicable transcripts. It is the Customer's responsibility to review any redacted output to ensure it meets Customer’s needs.

2. Bandwidth makes no representation or warranty that the Redaction Feature, or any output produced using the Redaction Feature, will satisfy the requirements of any law, regulation, or industry standard for redaction, anonymization, de-identification, or any other purpose. 

3. The Redaction Feature is not designed to meet the requirements for de-identification under medical privacy laws, such as the U.S. Health Insurance Portability and Accountability Act of 1996 (HIPAA). Customer may not submit, and the Service may not be used to process, any Protected Health Information under HIPAA. 

3. Language Limitation. Speech to Text API only supports transcription for languages specified by applicable model documentation provided to Customer, which may be updated from time to time.

Exhibit B

Innovation Studio Services Privacy Policy

Innovation Studio Services are unique, experimental services offered by Bandwidth. As our primary business, Bandwidth is a cloud-based communications provider for enterprises; these products and services include a broad range of software APIs for voice and text functionality, as well as our own IP voice network.  
This Privacy Policy applies only to personal data collected by Bandwidth through Innovation Studio Services available at labs.bandwidth.com, smartnumbers.labs.bandwidth.com,  harmony.labs.bandwidth.com, or other domains and applications offered by Bandwidth where this Privacy Policy is incorporated by reference.  It does not apply to any other service or interaction with Bandwidth as a communications provider or website operator.  Our general Privacy Notice is available at www.bandwidth.com/privacy.
As used in this Privacy Policy, “personal data” means any information that relates to, describes, or could be used to identify an individual, directly or indirectly.  Personal data does not include anonymous or de-identified data, which does not relate to an identified or identifiable natural person or cannot be linked to or identify an individual.
Please read this Privacy Policy carefully to understand how we collect and process personal data when you use and interact with Innovation Studio Services. 
What personal data is collected through Innovation Studio Services?

• Identifiers: When you use or interact with Innovation Studio Services, we may collect information that can be used to identify you, such as your name, telephone number, caller ID information, unique personal identifier, online identifier, or Internet Protocol (“IP”) address.
• Internet or other electronic network activity information: When you use or interact with Innovation Studio Services, we may automatically collect technical information about your call to our network, such as source and destination information, IP address, completion status, time and duration of use; we may also collect technical data about your equipment, telephone number, and telecommunications carrier. This information may include source and destination information about the call.
• Audio data: When you speak on a call with Innovation Studio Services, we may collect voice audio recorded during your interaction with Innovation Studio Services and we may transcribe the content of the call.  We will not collect or create a voiceprint or other biometric identifiers for the purpose of identifying you. If you do not wish to be recorded, you may end the call at any time and discontinue use of the Service(s). Please note that we do not intend or desire to collect sensitive personal information about you; you should not share sensitive information (including but not limited to Social Security numbers or other government identifiers, physical or mental health data, financial data, personal data revealing race or ethnic origin, religious beliefs, data relating to citizenship status, data relating to sexual orientation, criminal background or trade union membership) when interacting with the Service(s).
• Inferences of sentiment/emotion:  We may infer sentiment or emotion based on the tone of your voice, the content of your conversation, or other data points during the call.  
• Customer-supplied information:  When you use Innovation Studio Services as our customer, you may provide us with parameters and information to set up the service, including a business name, phone number, and information about your business necessary to configure the service.  This information may include personal data about you, your employees, or your representatives. If you enable optional integrations to third-party services you use, we may also collect information you agree to share with us from those services, such as calendar availability or contact information.  

• Google Calendar Data:  When you enable the Google Calendar integration, we may collect the following Google User Data:
  • Calendar Information: We read the names and metadata of the calendars associated with your Google account to allow you to select which calendar to use for scheduling.
  • Free/Busy Availability: We read your calendar availability and free/busy time blocks to identify open time slots and prevent scheduling conflicts.
  • Calendar Events: We access event details (reading, creating) for appointments managed through our application.

How does Bandwidth use personal data collected by Innovation Studio Services?
We may use the personal data we collect for one or more of the following purposes:

• To provide the service to you as our customer.  
• To interact with you as a caller and respond to your dialogue, prompts, and questions. Certain Innovation Studio Services, such as Harmony, are powered by AI models, including generative AI models, and will use your speech and any data you provide to respond with personalized answers.  
• To troubleshoot, ensure quality of the service, and improve the product.  
• To anonymize, de-identify, or aggregate data such that it does not identify you or any data subject. 
• To improve Bandwidth’s other products and services, optimize our network, and research and develop new products and solutions. 
• For testing, research, development, and analysis, including for the purpose of mitigation of fraud and spam, unlawful or abusive activity, or violations of our Acceptable Use Policy.
• To respond to law enforcement requests and as required by applicable law, court order, governmental regulations, or other legal process where we believe in good faith that disclosure protects your safety or the safety of others, or where we need to protect a legitimate business interest such as fighting against fraud that harms our rights.
• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Bandwidth’s assets, whether at Bandwidth’s discretion or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by Bandwidth about you is among the assets transferred.

When you enable the Google Calendar integration, we may use Google User Data for the following purposes:

• To Display Calendar Options: Calendar names are retrieved so you can choose which calendar your appointments should be created on
• To Detect Available Time Slots: Free/busy data for open time slots to our users end users.
• To Manage Appointments (CRUD Operations): Event data is read to display existing bookings, created when a new appointment is booked

The legal basis for collecting and using the personal data described above will depend on the personal data concerned, the relevant jurisdiction, and the specific context in which we process it, including but not limited to: (a) performance of a contract; (b) legitimate interest; (c) necessary for compliance with a legal obligation; or (d) consent to collect and process your personal data.
We may use non-personal data for any business purpose.  For example, Bandwidth may de-identify/anonymize or aggregate your personal data (so that it can no longer be associated with you), in which case we may use this information for any business purpose indefinitely without further notice to you. When we do this, we will maintain and use de-identified information in de-identified form and not attempt to reidentify the information, unless required by law.  
How does Bandwidth share or disclose personal data collected by Innovation Studio Services?
We may disclose your personal data to a third party for a business purpose, including those described in the “How we use your personal data” section above. Bandwidth may share your personal data in the following ways:

• To companies that perform services on our behalf only as needed for them to perform those services, including software infrastructure providers and other communications providers in order to route communications over the Bandwidth network.
• To third parties that enable the Service’s functionality in accordance with the license terms and privacy policies of these providers, including Google APIs Terms of Service.  
  • Our Services operate using self-hosted models; personal data will not be shared with any third-party model provider for training or secondary purposes.
• To any member of our corporate group, including our subsidiaries and affiliates.
• To other companies and entities to assist with preventing fraud and spam, unlawful and abusive activity, and identity theft.
• To third parties in connection with a business transaction to sell, transfer, merge, divest, restructure, reorganize, or dissolve all or a portion of our business or assets.
• To protect the rights, property, or safety of our business, our employees, our customers, or others.

We do not otherwise sell or share personal data collected by Innovation Studio Services.  
How can you exercise your privacy rights as a data subject?
You have certain rights regarding our processing of your personal data under applicable data protection laws. This section describes these rights and how you can exercise them.  Please note these laws may provide limitations or exceptions that apply to these rights. We have described these rights generally, without noting all applicable jurisdictions, limitations, or exceptions. When you make a request to exercise any of these rights, we may provide more detailed information regarding any exceptions or limitations that apply.

• Right to know. You have the right to ask us to confirm whether or not we process your personal data, the categories of personal data we have collected and the sources from which we collect it, our purposes for collecting your personal data, the categories of third parties to whom we disclose your personal data, and the specific pieces of personal data we have collected about you.
• Right to access. You have the right to request a copy of your personal data and supplementary information.
• Right to appeal.  You have the right to appeal our denial of any request validly submitted.
• Right to correction/rectification. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete information you believe is incomplete.
• Right to erasure/deletion. You have the right to request that we erase or delete your personal data, under certain circumstances and subject to certain exceptions.
• Right to restriction of processing. You have the right to restrict the processing of your personal data, under certain circumstances, including, depending on applicable law and the jurisdiction in which you reside or are located, opting out of disclosures of personal information to an unaffiliated third party who does not serve as our agent or service provider, if any, or (b) use of personal information for a purpose other than the purpose for which it was originally collected or subsequently authorized if any such use occurs.
• Right to data portability. You have the right to receive personal data you have provided to us in a structured, commonly used and machine-readable format that allows you to transmit the data to another controller without hindrance. You also have the right to request that we transmit this data directly to another controller.
• Right to withdrawal of consent. In the event our processing of your personal data is based on your consent, you may withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
• Right to object to processing. You have the right to object to the processing of your personal data at any time, under certain circumstances.
• Right to opt out of our processing, “sale,” or sharing of personal data for targeted or cross-context behavioral advertising. You have the right to opt out of our processing, “sale” (as that term is broadly defined in the California Consumer Privacy Act), or sharing of your personal data for targeted or cross-context behavioral advertising, which means displaying advertising to you based on personal data obtained or inferred from your activities over time across different websites, applications, and other online services we do not operate.
• Non-retaliation.   You have a right not to receive discriminatory treatment for exercising the rights described above.

Except as otherwise noted above, to exercise any of the above rights or if you have any questions about this Privacy Policy, please submit them through our DATA SUBJECT RIGHT REQUEST FORM.  US residents may also call us toll-free at 866-824-2792. 

• Making a request; Requests by others on your behalf. Only you, or someone legally authorized to act on your behalf (this includes an authorized agent), may make a verifiable consumer request related to your personal data using the methods described above. The response we provide will also explain the reason we cannot comply with a request, if applicable. 
• Fees. You will not have to pay a fee to access your personal data or to exercise any of the other rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
• Information we may need from you. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data or to exercise any of your other rights, such as your first and last name, email address, mailing address, telephone number, or other information necessary to verify your identity or that your representative is authorized to act on your behalf. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to assist with our response. Any personal data provided to us for verification and fraud-prevention purposes will only be used for that purpose and such information will be deleted as soon as practical after processing your consumer request.
• Timing. We try to respond to all legitimate requests within one month of receipt of the request. Occasionally, it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. 
• Appeals. If we refuse to take action on your request, you may appeal that refusal by contacting us through our DATA SUBJECT RIGHT REQUEST FORM or calling us toll-free at 866-824-2792.  

You may also make a complaint about our processing of your personal data to a relevant data protection supervisory authority. We would, however, appreciate the opportunity to address your concerns before you do so.
How does Bandwidth secure and how long do we retain personal data collected by Innovation Studio Services?
We will retain your personal data for as long as reasonably necessary to provide the service or to otherwise fulfill the purposes described in this Privacy Policy. How long we retain your personal data will depend on a number of factors, including:  our purpose for processing the personal data; the amount, nature, and sensitivity of the personal data; the potential risk of harm from unauthorized use or disclosure; and any legal obligations we are subject to. As noted above, we may also de-identify, anonymize, or aggregate your personal data (so that it can no longer be associated with you), in which case we may use this information indefinitely without further notice to you and will not attempt to re-identify you.
We do not retain any Google User Data outside of the call session to complete the scheduling task, during or immediately after the duration of the call session. 
Bandwidth takes precautions including administrative, technical, and physical measures to help safeguard against the accidental or unlawful destruction, loss, alteration and unauthorized disclosure of, or access to, the personal data we process or use. 
Bandwidth will process personal data collected by Innovation Studio Services for the purposes described in this Privacy Policy on servers located in various jurisdictions, including processing and storing your Personal Data in our facilities and servers in the United States. While data protection law varies by country, we apply the protections described in this policy to your Personal Data regardless of where it is processed, and only transfer that data pursuant to legally valid transfer mechanisms.
Not for use by children
Innovation Studio Services are not intended for use by anyone under the age of 18. If you are a parent or guardian of a child from whom you believe we have collected personal data in a manner prohibited by law, please contact us at privacy@bandwidth.com. If we learn that we have collected personal data from a child without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.
